He has since quit his job to work with human rights lawyers and currently serves as legal consultant for several civil rights organizations in China.

In the wake of China’s most severe human rights crackdown in decades, Liu has emerged as a prominent voice in the legal community. He has been dubbed by many as “the conscience of China’s legal profession” – a title he is both humbled and proud to have.

In this interview, Liu Xiaoyuan shares his thoughts on China’s legal system, government censorship, and the role of lawyers in a society where the rule of law is constantly under attack. He also discusses the rise of civic consciousness in China, fueled in part by China’s booming economy and widespread use of technology, and what it means for the country’s future development.

Q: How did you become interested in human rights and democracy issues?

I’ve always been interested in social justice and fairness. It was my passion for these issues that led me to study law in college. I started my career as a lawyer at a law firm that specialized in foreign investment, but I quickly grew disillusioned with the work. I felt that the system was rigged against the average Chinese citizen, especially those who lacked the resources to defend themselves.

In 2006, I became a sportscaster for China’s national network, CCTV. It was an exciting job and I enjoyed it very much, but I still had that nagging feeling that I wasn’t doing enough to push for positive change in society. So I decided to start using my Weibo account, which had over a million followers at the time, to advocate for human rights and democracy.

Q: What led to your being blacklisted by the Chinese government?

It all started with my Weibo post on the death of Chinese activist Cao Shunli in prison in 2014. Cao Shunli was detained in September 2013 after trying to travel to Geneva to participate in a UN human rights review. She died from organ failure due to inadequate medical treatment while in custody. I posted a photo of her, along with the phrase “Rest in Peace” in Chinese characters. That same day, I received a call from my supervisor at CCTV, telling me that I was being suspended for “spreading rumors and disrupting social order”. A few days later, my Weibo account was shut down and I was placed on a blacklist, which effectively prevented me from working in any media-related job.

Q: How has being blacklisted affected your career as a lawyer?

After being blacklisted, I was unable to find work in a law firm. I then set up my own practice as an independent lawyer, specializing in human rights cases. However, things haven’t been easy for me. Most of my clients are activists or dissidents, and they are often harassed and detained by the authorities. As their lawyer, I am often harassed as well. My office was raided and my computer and files were confiscated by the police in 2015. I’ve also been placed under surveillance and have had my movements restricted.

Q: Do you consider yourself to be a political dissident?

I don’t see myself as a political dissident, but I do speak out against the government and their actions. I believe in using the law to protect the rights of citizens, and sometimes that puts me at odds with the government. But I’m not a “political” person in the sense that I’m not trying to overthrow the government. I just want to see a more fair and just society in China.

Q: How would you describe the current state of China’s legal system?

The state of China’s legal system is complicated. On the one hand, there are laws and regulations in place that theoretically protect citizens’ rights. But in practice, these laws are often disregarded or selectively enforced by the government. The judiciary is not independent and is often influenced by the government, and the result is a lack of due process and the suppression of dissent. Moreover, the government only allows lawyers to take on cases that are deemed “acceptable” – usually those that don’t challenge the government’s authority. This has led to a lack of diversity and robust discussions within the legal community.

Q: What role do you think lawyers should play in a society like China, where the rule of law is constantly under attack?

Lawyers play a crucial role in upholding the rule of law and protecting citizens’ rights in a society like China. We have a responsibility to use the law to challenge the government’s actions and to defend the rights of the people. It’s not an easy job, but it’s a necessary one.

Q: China has seen a rise in civic consciousness in recent years. How do you think this will impact the future development of the country?

I think this is a positive development for China. The rise of civic consciousness has been fueled by China’s booming economy and widespread use of technology, which allows people to access information and to connect with each other. This has led to more people becoming aware of their rights and demanding accountability from their government.
